Title: Clean Water Act USACE Nationwide Permit Program

Summary: The United States Army Corps of Engineers (USACE) administers the nationwide permit (NWP) program which authorizes certain activities under Section 404 of the Clean Water Act and Section 10 of the Rivers and Harbors Act of 1899. USACE published a Final Rule in the Federal Register on 13 January 2021 authorizing the issuance of four new NWPs, the modification and reissuance of 12 existing NWPs and the modification and reissuance of the associated general conditions for these 16 NWPs. The effective date for these NWPs is 15 March 2021. USACE is not finalizing the new NWP E or the remaining 40 existing NWPs at this time. The 40 remaining NWPs, along with the associated general conditions and definitions, will continue to be in effect under the 06 January 2017 Final Rule. USACE representatives will provide an overview of these recent changes and additions as well as answer any corresponding questions.
Aaron Eilers – Biologist and Senior Project Manager. Mr. Eilers has worked in the environmental field for over 20 years, including the last 6 years in the USACE Denver Regulatory Office. Mr. Eilers received a master’s degree from the University of Denver in Environmental Policy and Management and a bachelor’s degree from the University of Massachusetts, Amherst in Wildlife and Fisheries Conservation and Management.
Lee Fuerst – Environmental Scientist and Senior Project Manager. Ms. Fuerst has worked in the environmental field for over thirteen years, including over five years of experience with USACE in the Norfolk Regulatory Office in Virginia and most recently the Denver Regulatory Office. Ms. Fuerst received a master’s degree from the University of Texas in Energy and Mineral Resources and a bachelor’s degree from Louisiana State University in Environmental Science.
