The U.S. Environmental Protection Agency continues to aggressively pursue the ability to research, restrict, and remediate PFAS, most recently through its PFAS Strategic Roadmap and rulemaking efforts under both CERCLA (Superfund) and RCRA. We can expect to see regulation emerge for a variety of environmental media, including air, land, and water. In this webinar, they will discuss practical takeaways from these recent developments, including timing for regulation, implications for environmental diligence, and what you can do in the meantime, including engaging state regulators. Specifically, they will examine:
- When to expect CERCLA and RCRA listings;
- What this means for environmental due diligence and how you can plan for those changes now; and
- Engaging with regulators to increase predictability and minimize risks.
Cynthia Teel advises clients on environmental issues that arise in the litigation, transactional, and regulatory contexts. She has extensive knowledge of state and federal requirements, particularly as they relate to landfills/solid waste, hazardous substances, agriculture, and oil & gas. Cynthia has represented clients in environmental negotiations/enforcement actions with federal and state agencies and assisted with litigation of environmental claims in administrative, state, and federal courts, including Superfund and odor nuisance class actions. She regularly analyzes real estate deals and tax credit projects for environmental risks and provides strategies for minimizing those risks. Recent regulatory experience includes a focus on emerging contaminants such as PFAS, and dealing with technologically enhanced naturally occurring radioactive materials (TENORM).
Jessie Rosell concentrates her practice in environmental law, representing clients in negotiating administrative claims with federal and state environmental agencies, advising clients in initiating and maintaining environmental regulatory compliance programs, and assisting in complex environmental and toxic tort litigation in federal and state courts. Jessie advises clients on compliance and permitting under federal environmental laws and regulations, including the Clean Water Act, the Comprehensive Environmental Response, Compensation, and Liability Act (Superfund), and the Resource Conservation Recovery Act (RCRA). Jessie’s litigation experience includes complex toxic tort claims, including class actions, contribution claims under CERCLA and state counterparts,
and general tort and business claims. Her work on complex environmental litigation includes pretrial discovery and motions practice, playing a key role in securing summary judgments and voluntary dismissals and defeating class certification at the pleadings stage.
