This presentation will cover a wide range of legal ethics issues, with a focus on new modifications and additions to the Colorado Rules of Professional Conduct, proposed new rules, recent court decisions pertaining to ethical issues, seminal attorney disciplinary cases, and new and revised CBA Ethics Committee opinions. After attending this session, attendees will have learned, among other things, prosecutors’ duty to disclose exculpatory evidence, when attorneys can advance basic living expenses to indigent clients, and the application of “the fairness principle” in the context of using attorney-client privilege as both a sword and a shield. Mr. Rothrock will also provide practical insights for avoiding ethical problems in the practice of law.

Mr. Rothrock’s practice emphasizes legal ethics and attorney discipline defense, and the law of practicing law. Since 1991, he has represented and counseled hundreds of lawyers, law firms, judges, bar applicants and non-lawyers in all aspects of the regulatory process in Colorado. He has served as an expert witness in dozens of cases related to the law of lawyering. He has also served on dozens of committees concerned with these subjects and spoken publicly on innumerable occasions. He has written extensively, including the Ethics and Professional Responsibility chapter in CLE in Colo., Inc.’s Annual Survey of Colorado Law from 1999 to 2016, when the survey ceased publication.

Mr. Rothrock is author of the book, ESSAYS ON LEGAL ETHICS AND PROFESSIONAL CONDUCT IN COLORADO (Continuing Legal Education of Colorado, Inc. 2003, Supp. 2008) and a former chair of the Colorado Bar Association Ethics Committee.
